Gerüstbau Kaiser aims to act ethically and in accordance with the law in all its business activities. The aim of whistleblower management is to protect the company, its employees and other individuals as well as our business partners and other stakeholders from damage caused by white-collar crime, such as corruption, cartels and fraud. At the same time, we focus on human rights in our own business area and along the entire supply chain.
If you have information about suspected white-collar crime, suspected violations of human rights (such as child labor, forced labor, occupational health and safety violations or discrimination) or information about possible environmental damage, we will be happy to receive it and treat it in strict confidence.

Data protection information
Who is responsible for data collection and processing?
Theodor Kaiser Gerüstbau GmbH, Floßhafenstraße 6, 41460 Neuss (hereinafter referred to as „Gerüstbau Kaiser“) collects and processes your personal data as the controller in the whistleblower portal. This serves to receive and process information on violations in connection with the business activities of Gerüstbau Kaiser, in particular those under the Whistleblower Protection Act (HinSchG) and complaints under the Supply Chain Due Diligence Act (LkSG) in a secure and confidential manner.
The appointed data protection officer is Mrs. Sengül Karcin.

What data do we collect and how and why do we process your data?
Personal data of natural persons (personal data) that are entered into the information system are stored in encrypted and password-protected form in a database operated on our behalf by EQS Group AG, which is located in a high-security data center in Germany.
Gerüstbau Kaiser uses the personal data, such as name and other communication and content data, confidentially and exclusively for the purpose of receiving and processing information in accordance with the above-mentioned laws in a secure and confidential manner. Depending on the use case, the legal basis for the processing of personal data is Article 6(1)(c) GDPR in conjunction with Section 8 LkSG, Article 6(1)(c) GDPR in conjunction with Section 10 HinSchG and Article 6(1)(f) GDPR to safeguard the interests of the data subject. f) GDPR to safeguard Gerüstbau Kaiser’s legitimate interest in investigating criminal offenses and violations of the law in connection with Gerüstbau Kaiser and to protect the company and its employees from possible harm; if applicable, the Group works agreement on whistleblower management and, under certain circumstances, specifically for the disclosure of personal data to other competent bodies, also consent pursuant to Section 9 (3) or (4) HinSchG in conjunction with Art. 6 (1) lit. f) GDPR. Art. 6 para. 1 lit. a) GDPR or Art. 9 para. 2 lit. a) GDPR.
Will the data be passed on?
Access to the data is restricted to a very narrow circle of expressly authorized and specially trained persons from the Scaffolding Kaiser Compliance organization, Data Protection, Security, Procurement or Human Resources, depending on their area of responsibility. In addition, depending on the content of the report and the progress of the review, a very limited number of other authorized persons, such as in particular the compliance and data protection organizations and the responsible departments of the respective DB subsidiaries concerned, may have access to this data, e.g. if the information relates to processes in the subsidiaries. The latter may also be based in countries outside the European Union or the European Economic Area. Appropriate safeguards are in place for data transfers to third countries outside the EU/EEA. These include the EU standard contractual clauses and an adequacy decision by the EU Commission.
When processing a report, it may be necessary to pass on personal data or information that allows conclusions to be drawn about the identity of a whistleblower to competent bodies outside the reporting office. For this purpose, we obtain the whistleblower’s consent in advance in accordance with Section 9 (3) HinSchG.
Every person who receives access to the data is obliged to maintain confidentiality. In the context of criminal prosecution or due to other obligations to authorities, personal data may have to be disclosed to state investigating authorities or other competent state authorities within the scope of legal obligations.
How long will your data be stored?
We only store your data for as long as is necessary to fulfill the purpose for which it was collected or if this is required by law. In each individual case, we check whether and for how long your data will be stored or archived before it is deleted in accordance with certain criteria laid down in a deletion concept. This usually takes place up to six years after the case has been closed. Matters relating to the LkSG are documented for at least 7 years.
What rights do data subjects have?
Data subjects have the right to request information about the data stored about them at any time.
They can request the correction, deletion and restriction of processing (blocking) of their personal data as long as this is legally permissible and possible within the framework of an existing contractual relationship.
You have the right to lodge a complaint with any data protection supervisory authority.
You may object to data processing on grounds relating to your particular situation if the data processing is based on our legitimate interests or is necessary for the performance of a public task.
